This Puppy Deposit Agreement (“Agreement”) is entered into on the date below, by and between the Breeder (Jessica Kilgore — Mtn Green Doodles) and the Buyer named below.

Buyer Information

1. Litter Information

Tell us about the litter you are placing a deposit on. Either Expected Due Date or Date of Birth applies.

2. Deposit Terms

The Buyer agrees to place a non-refundable deposit to reserve a puppy from the above litter with breeding rights. The deposit shall be applied toward the final purchase price of the puppy, including breeding rights, as specified below.

The Buyer understands that breeding rights are granted at the sole discretion of the Breeder and are based upon the Breeder's evaluation of the puppy's health, temperament, structure, pedigree, and overall breeding potential.

Puppy selections will typically occur at approximately five (5) to six (6) weeks of age, at the Breeder's discretion.

The Buyer understands that puppy selection is a date-sensitive process and agrees to participate in the scheduled puppy selection meeting, whether conducted in person, by video call, or through another method designated by the Breeder.

The Buyer agrees to make their puppy selection within the timeframe provided by the Breeder during the selection process.

Failure to attend the scheduled selection meeting, respond within the designated timeframe, or maintain communication with the Breeder may result in forfeiture of the Buyer's deposit and release of the reserved puppy to another family.

The Buyer understands that temperament, structure, health, reproductive potential, and overall suitability may be considered by the Breeder during puppy placement decisions in order to help ensure the best possible match for each breeding program.

The Breeder reserves the right to retain any puppy from the litter for breeding or program purposes.

The Breeder further reserves the right to deny placement or revoke breeding rights prior to final sale if concerns arise.

3. Additional Testing Terms

The Buyer understands that additional evaluations or testing may occasionally be performed by the Breeder prior to final puppy selection in order to assess breeding potential, structure, genetics, coat traits, temperament, or overall program suitability.

Any genetic testing, coat testing, color testing, trait testing, reproductive evaluation, veterinary evaluation, or other breeding-related testing specifically requested by the Buyer shall be performed at the Buyer's expense, including testing completed while the puppy remains in the Breeder's care prior to pickup or transfer.

The Breeder reserves the right to require payment for requested testing prior to submitting such testing services.

4. Refund & Transfer Policy

The deposit is non-refundable except under the following circumstances:

  • The litter does not produce a sufficient number of puppies;
  • The litter does not produce a puppy reasonably matching the Buyer's previously disclosed non-negotiable breeding preferences (as listed in the Litter Information section above);
  • Any testing requested by the Buyer is covered by the Buyer.

The Buyer understands that puppy appearance, coat texture, size, markings, color, reproductive development, and breeding potential may naturally vary and are not guaranteed.

The Buyer further understands that no refunds shall be issued for the purchase price of the puppy due to failed health testing, failed breeding certifications, infertility, reproductive complications, structural evaluations, temperament evaluations, or inability to breed.

However, if the dog is determined unsuitable for breeding based on documented failed health certifications or veterinary breeding evaluations, the Breeder may, at the Breeder's discretion, refund only the breeding rights fee portion of the purchase price upon:

  • Submission of supporting documentation; and
  • Proof of spay/neuter or approved gonad-sparing sterilization procedure (GSS).

No refund shall be issued for the base purchase price of the puppy.

The Buyer acknowledges that specific breeding program preferences, goals, or desired traits must be communicated to the Breeder prior to puppy selection.

5. Entire Agreement

This Agreement represents the entire understanding between the parties and shall be governed by the laws of the State of Utah.

No verbal statements or promises shall be considered legally binding unless included in writing within this Agreement.
